MEMBERSHIP TERMS & CONDITIONS

Welcome to the Terms and Conditions (“Terms”) for our EagleRider Melbourne Motorcycle Rental Loyalty Program. These terms are between you and Melbourne Motorcycle Hire Pty Ltd (“Us” or “We”) and/or its affiliates.

Requirements and Eligibility

You must be at least 21 years old.
All Membership Plans and their benefits are only available to Australian residents with a valid, current motorcycle driver’s license from the state they reside.
You must hold an Australian motorcycle licence with the correct endorsement to rent a street-legal motorcycle, although a motorcycle license is not required to purchase and join our membership.
You must have a valid major credit card with the billing address being that of an Australian resident.
You represent and warrant that you meet all the requirements listed above. We may, in our sole discretion, refuse to offer Membership to any person or entity and change our requirements criteria at any time. Further, Membership is offered only for your use, and not for the use or benefit of any third party.

Terms of Membership

This Loyalty Program is an annual membership commencing as a result of paying an annual subscription, that automatically renews on your anniversary date unless cancelled. The length of your membership term will vary based on your current active plan you have subscribed to. This information is available on your My Account Page on our web site. As all rental motorcycles are provided by EagleRider Melbourne, all other EagleRider Australia Rental and Tour Terms and Conditions as outlined in the Rental Agreement shall apply to all Members of this Loyalty Program.

1. By signing up for Membership in any manner, you agree and accept these terms, conditions, limitations and all other operating rules, policies, and procedures that may be published from time to time on the site and of which may be updated by us from time to time. If you do not accept these Terms, you are not permitted to, and you must not, access or use these Services or purchase Membership from us.
2. Certain sections of the Terms may be subject to additional terms and conditions specified by us from time to time; your use of Membership is subject to those additional terms and conditions, which are incorporated into these Terms by this reference.

Registration and Subscription

To join this Loyalty Program as a member you must choose and pay for a Membership Plan from our web site and provide accurate and complete information during the signup process to be subscribed. You may check and correct any input errors in your signup application or change your allocated password on our My Account page. You are solely responsible for the activity that occurs on your Account and for keeping your account secure and updated.

Limitations

You may not assign, resell, or transfer to any other person or entity the rights allowed or obligations required by this Agreement.

Membership Benefits

Membership benefits can be reviewed on our web site. All membership benefits and available models are subject to change at any time without notice. All booking requests are subject to availability at EagleRider Melbourne. Discounts offered as part of this Loyalty Program cannot be combined with any other sale, discount, or special. Reward Points have no cash value outside of this Program and are subject to expiration based on the current active Membership plan you are subscribed to. Membership Benefits Explained

1. Reward Points are accrued each time you Rent a motorcycle under a current active Membership plan, only if your membership dues are current.
2. Reward Points will provide a minimum of 15% discount when compared to EagleRider Melbourne’s Recommended Retail Rental Prices.
3. Members will also be entitled to take up Special DEALS exclusive to this Membership Program.
4.  Members can choose to Rent Motorcycles using points, cash, or a combination of both.
5. Ride Points may be carried over for up to twelve months, depending on the Membership plan you are currently subscribed to so long as membership is not interrupted.
6. Ride Points may not be borrowed from future months.
7. Ride Points can only be used for new reservations, they may not be used for existing reservations or reservations that have already been confirmed.
8. For a complete list of available models please visit eaglerider.com.au/melbourne. EagleRider Melbourne fees such as optional insurance excess reduction, one-way fees, and other optional fees will be charged for and collected at the time of motorcycle pick up.
9. Reward Points are only valid off the standard EagleRider Melbourne retail daily rental rate.

Redeeming Ride Points

Here is how to redeem your Ride Points.
1. Go to melbournemotoryclehire.com.au.
2. Log on using your password on the MyAccount Page.
3. Use the Booking Request Page to request a booking for the bike you want to rent
4. The system will give you the option to apply available Reward Points to your booking.

Renewal and Grace Period

Your Membership is either an annual or a monthly recurring payment for a term of 12 months. This 12-month term will automatically renew annually unless you opt-out of renewal. Your subscription will continue indefinitely until cancelled by you. We reserve the rights to suspend or not renew any membership.
If you opt-out of auto-renewal, and are at the end of your Membership term, you will have 60 days after the end of your term (“Grace Period”) to utilize all remaining ride points in your account. You will not be entitled to any other benefits or discounts during this Grace Period.

Fees and Billing

Current monthly Membership fees can be reviewed at Melbournemotorcyclehire.com.au.
Prices are subject to change at any time without notice.
From time to time, we may offer different Membership plans, and the fees for such Membership may vary. Membership fees are non-refundable except as expressly forth in these Terms.
By signing up for Membership, you agree to make payments for all fees in effect for your current active Membership plan and authorize us to charge the payment method we have on file for you on each date your payment becomes due. We reserve the right to correct any errors or mistakes made with your billing of payments even if it has already been requested or received.
If all eligible payment methods we have on file for you are declined for payment of your Membership fees, you must provide us a new eligible payment method promptly or your membership will be cancelled. If you provide us with a new eligible payment method and are successfully charged, your new membership period will be based on the original renewal date and not the date of the successful charge. We reserve the right to use our payment processor to update and charge any payment method that is not up to date in our records. If we do not receive payment from you, you agree to pay all amounts due on your Membership account upon demand.

Failure to Collect

By subscribing to Membership, you authorize Melbourne Motorcycle Hire Pty Ltd to charge your credit card, debit card, or any other payment method at such time, at the annual reoccurring time, and at the beginning of any subsequent subscription period, including any enrollment fees, sales, or similar taxes imposed on your subscription payments.
If Melbourne Motorcycle Hire is unable to collect payment, Melbourne Motorcycle Hire will continue to attempt collection thereafter. Melbourne Motorcycle Hire is not responsible for overdraft fees. Past-due accounts will not be provided with any membership benefits, and rental credits/credit-based reservations will be frozen until payment is made or until expiring after 30 days of non-payment. Past due accounts are subject to collection by a third party if minimum membership term is not met.

Membership Cancellation and Opt Out

Membership will continue until cancelled by you at renewal time only. Melbourne Motorcycle Hire reserves the right to cancel or not renew any membership. You may opt-out of your next membership using the My Account Page as follows:

3. Click the Manage menu item
4. Click the Cancel button
Remember, you are still liable for payments for the remainder of your subscription term.

UNLESS YOU NOTIFY US BEFORE THE END OF YOUR MEMBERSHIP TERM THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR MEMBERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.

Booking Changes/Cancellations

Reservations made using Reward Points are non-refundable and cannot be amended. You can receive an EagleRider Melbourne store credit for the amount you paid however, all Reward Points used for the initial booking would be forfeited.

RENTAL TERMS AND CONDITIONS

  1. INTERPRETING YOUR RENTAL AGREEMENT

In these Terms and Conditions: MMHAT means Melbourne Motorcycle Hire and Tour Pty Ltd ACN 611878801 which is the owner of the Motorcycle which is rented to You under this Rental Agreement.

Rental Contract means the agreement You have with MMHAT for the rental of the Motorcycle and consists of: (a)     the Rental Agreement (Rental Agreement); and (b)     these Terms and Conditions of Rental (Terms and Conditions).

Damage Cover Excess means the amount payable in the event of loss or damage in accordance with clause 3.2. The Damage Cover Excess amount is equal to double the Security Bond but can be reduced by 50% subject to an optional daily Damage Cover Excess reduction fee as per the Cost Schedule.

LAMS means the Learner Approved Motorcycle Scheme in Victoria Australia.

Major Breach means a breach of any of clauses 2.1, 2.2, 4.1(a), 6, 7.7, 7.8 or 10.1 that causes damage to the Motorcycle or to the property of any third party.

Motorcycle means the motorcycle described in the Rental Agreement and includes its parts, components, accessories, riding gear including all accessories, keys, equipment and tools or any motorcycle substituted by MMHAT pursuant to the Rental Contract

Rental Period means the period commencing on the date shown on the Rental Agreement and ending on the date the Motorcycle is returned.

Security Bond means the amount MMHAT charges and holds until the safe return of the Motorcycle in accordance with the Rental Agreement. The Bond amount is shown on the Rental Agreement and the Cost Schedule.

Insurance Excess Fee means the maximum amount that MMHAT charges You in the case where the Motorcycle is returned damaged. The Insurance Excess Fee is shown on the Rental Agreement and the Cost Schedule below.

Insurance Excess Reduction Fee means the amount MMHAT charges in order to reduce the Insurance Excess Fee.  The Insurance Excess Fee is shown on the Rental Agreement and the Cost Schedule below.

Reduced Insurance Excess Fee means the maximum amount that MMHAT charges in the case where the Motorcycle is returned damaged and the person renting the motorcycle has paid the Insurance Excess Reduction Fee. The Reduced Insurance Excess Fee is shown on the Rental Agreement and the Cost Schedule below.

You, Your means the person shown on the Rental Agreement who rents any Motorcycle from MMHAT.

  1. DRIVER LICENCING REQUIREMENTS AND MOTORCYCLE TYPES

You agree and acknowledge that You have:

  1. a valid licence that is appropriate to ride the chosen Motorcycle class;
  2. the licence is current for the Rental Period; and
  3. it shows Your current residential address;
  4. You are over the age of 25 if provisionally licensed and over 21 if fully licensed;
  5. You have the relevant training and experience to be able to competently ride the motorcycle you are renting from MMHAT
  6. You have not had Your driver’s licence cancelled or suspended within the last three years; and
  7. You alone are responsible for the operation of the Motorcycle.

2.1  You must provide a valid Australian Photo Licence or a valid International Licence written in English or translated into English showing approval for the type and size of the Motorcycle requested to hire plus one other type of identification (e.g. bank card, passport etc).

2.2       At the Start of the Rental We will conduct a conduct a short induction to make sure You are familiar with the handling of the Motorcycle and its controls. This may require You to ride the Motorcycle for a short test drive so that We are satisfied You have the competence to safely ride the Motorcycle during the Rental Period. As safety is Our principal concern, if in Our opinion You do not have the skill or competence to ride the Motorcycle We may decline the rental. If that should occur, any prepaid charges will be refunded in full.

2.3       MMHAT offers the following Motorcycles for rental:

LAMS Motorcycles:

  1. You must be aged 21 and over and have a current Provisional or Learner licence to rent this Motorcycle and You will be subject to the Security Bond and Damage Cover Excess as per the Costs Schedule.
  2. You must not carry any pillion passengers and abide by all other restrictions applicable to this type of license.
  3. This type of Motorcycle must only be ridden on Council Gazetted Bitumen Roads.

Non-LAM Street Class Motorcycles:

  1. You must be at least aged 21 and You must have an unrestricted Motorcycle licence to rent this type of Motorcycle and You will be subject to the Security Bond and Damage Cover Excess as per the Costs Schedule.
  2. This type of Motorcycle must only be ridden on Council Gazetted Bitumen Roads.

Adventure Touring Motorcycles:

  1. You must be at least aged 25 and You must have an unrestricted Motorcycle licence to Rent this type of Motorcycle and You will be subject to the Security Bond and Damage Cover Excess as per the Costs Schedule.
  2. You must be able to demonstrate that you have the relevant experience riding this type of motorcycle to Rent this type of Motorcycle.
  3. This type of Motorcycle must only be ridden on Council Gazetted Roads.

Harley Davidson and other Cruiser Style Motorcycles:

  1. You must be at least aged 25 and You must have an unrestricted Motorcycle licence and You will be subject to the Security Bond and Damage Cover Excess as per the Costs Schedule.
  2. You must be able to demonstrate that you have the relevant experience riding this type of motorcycle and that this experience is relevant to your intended Rental.
  3. This type of Motorcycle must only be ridden on Council Gazetted Bitumen Roads.

Harley Davidson and other Touring Motorcycles:

  1. You must be at least aged 25 and You must have an unrestricted Motorcycle licence and You will be subject to the Security Bond and Damage Cover Excess as per the Costs Schedule.
  2. You must be able to demonstrate that you have the relevant experience riding this type of motorcycle and that this experience is relevant to your intended Rental.
  3. This type of Motorcycle must only be ridden on Council Gazetted Bitumen Roads.

2.4  You and any pillion rider acknowledge Your understanding that Australian approved helmets are compulsory at all times whilst riding a Motorcycle in Australia and that fines and penalties are issued by the police for failure to do so.

2.5  MMHAT reserves the right to refuse the hire of the Motorcycle if any of the conditions of this clause 2 are not met.

2.6  Irrespective of the level of Damage Cover that applies to the MMHAT Rental Contract, You have no cover for damage or personal injury other than the cover provided by compulsory third party insurance applicable to the state where the Accident occurs.

2.7 Until a claim has settled by payment to MMHAT, the Damage Excess must be paid by You.

  1. LOSS DAMAGE WAIVER, DAMAGE AND LOSS OF PROPERTY

3.1 You are liable for:

  1. the loss of, and all damage to, the Motorcycle; and
  2. all damage to the property of any person, which is caused or contributed to by You or which arises from the use of the Motorcycle by You or any person You allow to use the Motorcycle.

3.2 Subject to clause 3.3 and with payment of up to the Damage Excess shown on the Rental Agreement for each separate event involving damage to or loss of the Motorcycle or for each separate event involving damage to the property of any third party which is caused by the use of the Motorcycle by You, MMHAT:

  1. waives Your liability under clause 3.1 for damage to the Motorcycle or loss of the Motorcycle; and
  2. agrees that You are entitled to be indemnified under a policy of motor insurance provided by a registered insurer for Your legal liability to a third party for damage to the property of that third party which is caused by the use of the Motorcycle by You.

3.3 In addition to clause 3.2 You are liable and must always pay to MMHAT the following additional costs and fees:

  1. the cost of rectifying any tyre damage not attributable to normal wear and tear;
  2. the cost of repairing any damage caused deliberately or recklessly by:
    1. You;
    2. any other rider of the Motorcycle; or
  • any passenger carried during the Rental Period;
  1. the cost of repairing any damage to the Motorcycle or to third party property caused by You using, or permitting the Motorcycle to be used, in any area prohibited by the Rental Agreement; and
  2. the cost of repairing any water damage to the Motorcycle or any underbody damage, and any resulting damage from that underbody damage, to the Motorcycle.

3.4 For the purposes of clause 3.3 the amount You must pay for any damage or repair that may be reasonably determined by MMHAT includes:

  1. the cost of repairs to the Motorcycle or the market value of the Motorcycle at the time of the loss or damage, whichever is the lesser;
  2. appraisal fees;
  3. towing, storage and recovery costs;
  4. reasonable administrative fees reflecting the cost of making arrangements for repairs and towing and other administrative activities; and
  5. a per day loss of use fee based on the estimated downtime of the Motorcycle. If the amount determined by MMHAT and paid by You under this clause 3.4 exceeds the final cost of the damage or repair, MMHAT will refund the difference to You.

3.5 The Security Bond paid prior to the start of the Rental Period is fully refundable provided that:

  1. all amounts due to MMHAT under the Rental Agreement have been paid;
  2. the Motorcycle has been returned to MMHAT at the date and time set in the Rental Agreement;
  3. the is no damage to the Motorcycle or third party loss;
  4. the Motorcycle has a full tank of fuel; and
  5. there has not been a Major Breach of these Terms and Conditions.

3.6 Until a claim is settled by payment to MMHAT, the Damage Excess must be paid by You.

  1. VEHICLE CONDITION AND RETURN

4.1  MMHAT delivers the Motorcycle to You in good operating condition. You must return the Motorcycle to MMHAT:

  1. either to the place, on the date and by the time shown on the Rental Agreement or have it ready for collection by MMHAT at the place, on the date and by the time shown on the Rental Agreement; and
  2. in the same condition as it was at the commencement of the Rental Period, fair wear and tear excepted.

4.2 If You return the Motorcycle later than the time shown on the Rental Agreement or the Motorcycle is not ready for collection by MMHAT as agreed on the Rental Agreement, You are liable for all additional rental charges on a day to day rental rate (refer Costs Schedule).

4.3 Acting reasonably, MMHAT reserves the right to request the immediate return of the Motorcycle, or MMHAT may repossess the Motorcycle without notice, at Your expense should any of the following occur:

  1. You have committed a Major Breach of these Terms and Conditions;
  2. damage to the Motorcycle, or injury to persons or property is likely to occur;
  3. the Motorcycle will be involved in an industrial dispute;
  4. the Motorcycle is illegally parked and presents a danger to other road users or is exposed to probable risk of damage;
  5. the Motorcycle is used in violation of any law which constitutes an indictable offence; or
  6. the Motorcycle is apparently abandoned.
  7. You must also pay MMHAT any cost it incurs as well as all costs and charges under the Rental Agreement for the period up to return/repossession of the Motorcycle.

4.4 MMHAT reserve the right to refuse hire of another or additional Motorcycle to You following any incident or accident or where You have committed a Major Breach of these Terms and Conditions.

4.5 If the Motorcycle is returned early, there is no refund for the unused portion of the Rental Period.

4.6 Should You desire to extend the hiring period beyond the due date and time, authorisation must be sought from MMHAT. Such authorisation must be sought prior to the due in date and time as shown in the Rental Agreement otherwise MMHAT shall immediately report the Motorcycle as stolen.

  1. CLAIMS AND PROCEEDINGS
  • Where the use of the Motorcycle by You or any other person results in an accident or claim, or where damage or loss (including theft of the Motorcycle) is sustained to the Motorcycle or any third party property, You must:
  1. promptly report such incident to the local police and obtain a police report (where required by the state or territory law);
  2. promptly report such incident in writing to MMHAT (within a maximum of 24 hours) and complete any incident form provided by MMHAT;
  3. not, without MMHAT’s written consent, make or give any offer, promise of payment, settlement, waiver, release, indemnity or admission of liability;
  4. permit MMHAT or its insurer at its own cost to bring, defend, enforce or settle any legal proceedings against a third party in Your name;
  5. permit or ensure that MMHAT may claim in Your name, and assist MMHAT in making such a claim; and
  6. complete and furnish to MMHAT within a reasonable time any statement, information or assistance which MMHAT or its insurer may reasonably require, including attending at a lawyer’s office and at Court to give evidence.
  1. UNAUTHORISED AND PROHIBITED USE
  • For the duration of the rental agreement the MMHAT Motorcycle must not be used:
  1. whilst You are under the influence of alcohol, drugs or have a blood alcohol content or level of drugs present in blood, urine or oral fluid that exceeds the legal limit in the State or Territory in which the Motorcycle is driven or as permitted by Your licence and You must not do or take anything that may adversely affect Your ability to operate the Motorcycle;
  2. on off road conditions, unless specifically authorised by MMHAT in writing at the start of the rental – appropriate tyres needs to be fitted for such arrangements – the only permitted exceptions are unsealed car parking, driveways, tourist parking spots and road works closely connected to sealed roads.
  3. outside of mainland Australia or Tasmania;
  4. by persons other than those identified on the Rental Agreement;
  5. to propel or tow another vehicle, trailer, boat or any other object;
  6. to carry more than 1 pillion passenger (where allowed by Your licence class) and/or a greater load than that permitted by the law;
  7. to carry passengers for payment or reward of any kind;
  8. to carry any animal or pet;
  9. to carry any inflammable substance or any other explosive or corrosive substances;
  10. to transport goods including water skis, surfboards, bicycles, canoes or the like on the Motorcycle;
  11. in a manner and/or for the purposes other than for which the Motorcycle was designed and constructed;
  12. for any illegal purpose, race, contest or performance test of any kind;
  13. on beaches or through streams, rivers, creeks, dams, floodwaters or through snow;
  14. when it is damaged or unsafe; or
  15. to perform paid work such as food delivery or courier services;
  1. USE OF MOTORCYCLE

7.1 Rental is strictly for the period of time stated and late fees will be charged for late returns. If the Motorcycle is returned late You remain subject to all these terms and conditions.

7.2 Limited kilometres are included in the Rental Agreement.

A Daily Limit of 350 kilometres is included in your Rental Agreement.  If the Rental occurs over multiple days the total kilometres will be divided by the number of days to calculate the average number of kilometres travelled per day.  Additional charges will apply if the Daily Rate is exceeded.  The rate charged for this is contained in our Terms and Conditions listed on our Web Site and which will be made available to you at Pick Up.

7.3 One way travel is permitted to any capital city within Australia only with the prior written approval of MMHAT and any resulting costs incurred by MMHAT in returning the Motorcycle will be at Your cost (the price can be quoted upon request).

7.4 Long Term Rental:

  1. Where the Motorcycle is rented for an extended period of time (more than 7 days) or distance (more than 3,000 km’s) and requires any tyres to be replaced or where any scheduled service must be conducted within the Rental Period, You must provide full assistance to MMHAT to arrange such servicing;
  2. all costs directly related to such works under this clause will be paid by MMHAT direct to the service provider (where possible) or (if not) reimbursed to You upon presentation of valid receipts;
  3. the service provider, choices of items and location are at MMHAT’’s sole discretion; and
  4. we must be advised at the time of booking (in writing) if You plan to travel more than 3,000km during the Rental Period.

7.5 You are liable for any unauthorised repairs to the Motorcycle and for all parking and traffic infringements in respect of the Motorcycle during the Rental Period.

7.6 Fuel:

  1. You must use as a minimum Premium Unleaded Fuel (95 Octane) in the Motorcycle;
  2. You are liable for and must pay for any damage caused by the use of incorrect fuel; and
  3. the Motorcycle is provided with a full tank of fuel and You must return it with a full tank of fuel. An administrative fee, plus the cost of the fuel, will be charged if the Motorcycle is returned without a full tank (refer to Cost Schedule)

7.7 You agree to take reasonable care of the Motorcycle during the Rental Period and:

  1. to operate it in an appropriate and responsible manner at all times; and
  2. to prevent anyone who is not an authorised rider from using or taking possession of the Motorcycle.

7.8 You agree not to act offensively whilst riding the Motorcycle.

7.9 The use of the motorcycle at any racetrack, track day or closed circuit event is prohibited; with the exception of closed circuit rider training events.

  1. FINANCIAL OBLIGATIONS

8.1 Prior to the commencement of the Rental Period:

  1. You must pay to MMHAT the cost of the rental fee; and
  2. on the day of collection of the Motorcycle a preauthorisation on Your credit card will be obtained for the amount of the Security Bond as shown in in the Rental Agreement (refer to Cost Schedule).

8.2 At the end of the Rental Period, You must pay:

  1. all outstanding charges specified on the Rental Agreement and all charges payable under the Rental Contract;
  2. any amount paid or payable by MMHAT or You to any person arising out of Your use of the Motorcycle or imposed on You or MMHAT by any governmental or other competent authority (such as speeding, parking and traffic fines, tolls or any other infringement or penalty issues in relation to use of the Motorcycle by You); and
  3. any amount for which You are liable to MMHAT under the Rental Agreement, in respect of a breach of the MMHAT Rental Contract or otherwise.

8.3 Where required by law, MMHAT will pass on Your details to any governmental or other relevant authority.

8.4 By entering into this Rental Contract You authorise us to debit Your credit card or charge account with all moneys payable under the Rental Agreement. You may pay by cash, bank transfer (funds to clear first), Visa or MasterCard.

8.5 we will pay any refund due to You within a reasonable time.

8.6 we will not refund the rental charges if mechanical damage is caused by the misuse or abuse of the Motorcycle. You will remain liable for the rental charges for the remainder of the unexpired Rental Period together with all repair costs, replacement parts and costs for the cancellation or postponement of the rental of the Motorcycle to future customers as a result of its unavailability.

  1. This will be calculated by determining the percentage usage, over 60 days immediately preceding the damage, and multiplying this by the number of days that the Motorcycle is unavailable.
  1. CANCELLATION

9.1 All rental cancellations must be made in writing. The following cancellation fee structure applies:

  1. 50% of total rental fee or an amount equivalent to two day’s rental fee whichever amount is the smallest, applies if cancellation is made one week prior to the commencement of the Rental Period; and
  2. 100% of total rental fee or an amount equivalent to three day’s rental fee whichever amount is the smallest, applies if cancellation is made less than one week prior to the commencement of the Rental Period.

MAINTENANCE

10.1 You Must:

  1. conduct a visual inspection of the whole Motorcycle each day before use including checking front and rear tyre condition (pressure & wear), all lights, horn, both front and rear brake operation, engine oil, chain lubrication and dash for any warning lights;
  2. keep the Motorcycle secure and the keys under Your personal control at all times and not leave the Motorcycle unlocked and unattended at any time;
  3. comply with all Australian road laws;
  4. use the alarm (where fitted) to protect the Motorcycle from theft; and
  5. if any warning lights remain illuminated, immediately contact us to discuss what action needs to be taken.

10.2 In the unlikely and unforeseen event that You require assistance for any mechanical troubles or difficulties with the Motorcycle or is involved in an accident or is damaged or is stolen, You must immediately contact us.

10.3 we will assist You with arrangements for towing or repairs or exchange of the Motorcycle however we give no warranty that we will be able to repair or replace the Motorcycle during the Rental Period as a replacement is always subject to availability.

10.4 we will not be liable for any delays, costs, damage or losses incurred due to breakdown, accident, damage or theft of the Motorcycle and will not be required to refund the remaining Rental Period. We recommend that You take out travel insurance for this purpose.

10.5  If the Motorcycle has mechanical difficulties, You must assist us to deliver the Motorcycle to a safe, secure location.

10.8 If the mechanical difficulties (e.g.: flat battery, no fuel, any misuse etc.) or damage are caused by You a call out fee plus any costs incurred to render assistance will be charged.

 

  1. LIABILITY, INDEMNITY AND RISK

11.1 Unless it is negligent, MMHAT is not liable to You or any person, and You indemnify MMHAT, for any loss of, or damage to, any property:

  1. stolen from the Motorcycle or otherwise lost during the Rental Period; or
  2. left in or on the Motorcycle at any time before, during or after the Rental Period.

11.2 You fully understand and acknowledge that being on a Motorcycle can be dangerous and can expose You or others to potential injury or death, and that MMHAT is unable to control the way other motorists drive or act and You unreservedly accept that risk.

  • You acknowledge that if Travelling here from Overseas or Interstate and if applicable and available to you, You have been advised by MMHAT to obtain Personal Travel Insurance.
  • No provision of this Rental Contract is intended to or does exclude, restrict or modify any terms implied by, or rights You have, under the Competition and Consumer Act 2010, the Australian Securities and Investments Commission Act 2001 or any other Federal, State or Territory legislation to the same effect.
  1. SECURITY BOND AND DAMAGE EXCESS SCHEDULE

A security bond will be held during the period of rental as listed below, which will form part of the costs due if the motorcycle is damaged, involved in an accident or not returned.
